1. There are too many cases and allegations in the public domain about the misconducts and abuses by Attorney-General Gani Patail. Last week I showed the book by Zainal Abidin Ahmad titled ‘Tan Sri Abdul Gani Patail: Pemalsu, Penipu, Penjenayah?’ and invited AG Gani Patail to respond. He has not.

2. Yesterday, I appeared on TV2 in a Mandarin talk show and spoke about AG’s selective prosecution. I spoke about the Karpal Singh sedition trial where others including government leaders who had said more seditious stuff are not charged but Karpal Singh is made to go through this persecution because according to the DPP who spoke in court, AG Gani Patail’s has sole discretion and absolute power in deciding who to prosecute and that discretion cannot be questioned by anyone, not even the court.

3. I ask, so not even Parliament can control AG Gani Patail? So the AG is supreme to Parliament? We have a man so drunken with power that he can be so arrogant to fix up people and thinks he can get away with it. That was what happened to me when I asked AG Gani Patail to explain his Hajj Trip with Tajudin Ramli’s proxy; about the AG taking sides in the corporate tussle involving Ho Hup Bhd and charged Dato TC Low for some minor offences.

4. I also spoke about the official representation that I had received from Lawyer Rosli Dahlan in 2010 pleading for the MACC to drop his case when it became evident that the MACC had no case against that innocent man and some of the MACC DPP and witnesses were lying in the trial of Dato Ramli Yusuff.

Have Tribunal To Address Allegations Made Against Gani

Malaysiakini reported on Friday that outspoken former Malaysian Anti-Corruption Commission (MACC) panel member Robert Phang has been cleared of the corruption allegations made against him.This follows the confirmation by the MACC director of investigations Mustafar Ali in an SMS in response to a query from Malaysiakini.

Phang had been issued with a letter from Mustafar, dated November last year, clearing him of the allegation made by an anonymous blogger.However, the letter from the MACC that cleared Phang also stated that it cannot be used for the purpose of publication by the media.

The MACC Chief Commissioner Abu Kassim Mohamed should be censured in Parliament if he cannot give satisfactory explanation why MACC suppressed information for some 15 months that Phang had been cleared of corruption allegations made against him.

In this connection, the Chairman of the MACC’s Operations Review Panel, Hadenan Abdul Jalil should also explain why he withheld information about Phang being cleared of corruption allegations some 15 months ago in May last year.

MACC clears Robert Phang of graft accusation

Outspoken former Malaysian Anti-Corruption Commission (MACC) panel member Robert Phang has been cleared of the corruption allegations made against him.

MACC director of investigations Mustafar Ali today confirmed this in an SMS in response to a query from Malaysiakini.

Phang has also been issued with a letter from Mustafar, dated November last year, clearing him of the allegation made by an anonymous blogger.

However, the letter from the MACC that clears Phang also states that it cannot be used for the purpose of publication by the media.

"The prosecutors have made the decision and cleared Phang from the corruption allegation. It was also announced by the Operations Review panel," Mustafar said in an SMS earlier this week.

Phang resigned from the MACC panel early last year, declaring he needed to preserve his and the MACC's integrity, and allow the graft commission to investigate the claims against him without any fear of conflict of interest.

His decision to resign stemmed from damning allegations that he had bribed a senior officer of the Home Ministry.

Commenting on the MACC's confirmation that he has been cleared of the allegations of corruption, Phang, 72, said he was thankful that the anti-graft body had cleared him.

"The allegation (made in the blog) was baseless as it only surfaced early last year, following my criticism of attorney-general Abdul Gani Patail over his haj trip in 2010.

"I had said that Gani went on the trip with a shady character, Shahidan Shafie, who is a close acquaintance of former Malaysia Airlines chairperson Tajudin Ramli.

The recent statement by MCA president Datuk Seri Dr. Chua Soi Lek said that it was unfair to rely solely on the police to curb rising crime in shopping complexes. He went on say that operators or owners of shopping malls should be made responsible for helping to deter crime on their premises by providing adequate and efficient security measures. The MALLS management have a duty to strengthen security measures and that we cannot depend solely on police as police cannot be everywhere.

Obviously Dr.Chua is concerned about security issues in the country ,“ Especially those on shopping malls”. In the interest of nation and especially now we must pull our self together, all walks of life and communities and the rakyat must come forward to work together to fight and prevent crime from happening.

It is true that fighting crime is everybody’s responsibilities. Dr.Chua ,your effort in this aspect must be commendable. To all politicians, MP’s & Adun’s please do like wise.

Probe A-G before government integrity harmed further, says ex-cop

KUALA LUMPUR, Aug 8 ― The police must investigate Tan Sri Abdul Gani Patail for power abuse in light of a new book accusing the Attorney-General of being a fraud, a cheat and a criminal, and show the same diligence with which they probed a sensational 1998 book on why Datuk Seri Anwar Ibrahim could not be prime minister, a former senior policeman said today.

 Retired criminal investigation chief Datuk Mat Zain Ibrahim told Inspector-General of Police (IGP) Tan Sri Ismail Omar that the men in blue must probe the government’s top lawyer due to the increasing public pressure and scrutiny, which he suggested could irrevocably damage public trust in government institutions.

“We have seen and are fed up of trickery and Gani Patail’s lies in handling the RCI’s on the black-eye incident, VK Lingam, and most clearly in the Teoh Beng Hock RCI,” he said in an open letter to the IGP.
Abdul Gani, who has extensive authority over the country’s legal affairs, has been repeatedly accused of fabricating evidence in the 1999 sodomy and corruption trial of Anwar, a deputy prime minister-turned-opposition leader, by Mat Zain whose open letters to the authorities were among the sources of Zainal Abidin Ahmad’s book.

Mat Zain had written to the IGP following the recent publication of a book titled “Tan Sri Abdul Gani Patail: Pemalsu, Penipu, Penjenayah? (Tan Sri Abdul Gani Patail: Fraud, Cheat, Criminal?)” written by Zainal.
He noted that a leading public figure, businessman Tan Sri Robert Phang who was also a former advisor to the Malaysian Anti-Corruption Commission, had filed a police report against Abdul Gani two days ago, based on the contents of the book.

“I got to know that several people who have scrutinised Zainal’s book on Gani Patail, hope the police will investigate the contents as the police diligently investigated the book ‘50 Dalil’ related to Anwar Ibrahim,”

The ex-police officer was referring to a controversial 1998 book, “50 Reasons Why Anwar Cannot Become Prime Minister” written by Khalid Jafri, an ex-editor of the Umno-owned newspaper Utusan Malaysia, which alleged that the then-deputy PM was gay in a Muslim-dominated country that criminalises sodomy.
Today, Mat Zain said Abdul Gani’s high-ranking position as the public prosecutor did not indemnify his past actions or make him immune to prosecution as all citizens are equal before the law.

He highlighted as an example minister Datuk Seri Nazri Aziz’s reply to Parliament on March 30 last year that the A-G does not have the power to “indemnify” anyone from crime based on political considerations.

Mat Zain added that the author could not prove his allegations about Abdul Gani’s wrongdoings on his own.
“However, I can, I am willing and ready to prove the allegations against Gani Patail and Musa Hassan, especially related to the forgery and cheating in the black eye incident that is still being debated to today,” the ex-CID chief said in the letter.

He was referring to the 13-year-long scandal alleging both the A-G and then-IGP Tan Sri Musa Hassan, of fabricating evidence to cover up Anwar’s bruised face after being beaten up while under police custody.

Mat Zain said there were many outstanding questions that Abdul Gani and the authorities have yet to answer.
He said Nazri, a minister in the Prime Minister’s Department and the de facto law minister, has pledged to look into the mystery of RM40 million worth of assets belonging to former Malacca chief minister Tan Sri Rahim Thamby Chik (RTC), that had been acknowledged previously by Abdul Gani and anti-graft officials.
“If it has been returned to RTC, what is the Attorney-General’s power to do so when the assets were confirmed obtained by corruption and power abuse?” Mat Zain asked.

The ex-policeman appeared to suggest that the A-G’s alleged power abuses may continue unless checked now.He warned that the government’s move to hold royal panels to investigate national issues ― such as the ongoing controversy illegal immigrants being fast-tracked for citizenship in Sabah and the oil royalties for Kelantan, which has been deprived of income for decades, which have both been turned into electoral fodder in the run up to national polls ― would not benefit the public with Abdul Gani in the A-G’s chair.
“Wherever there are elements of Gani Patail’s involvement in any panel, committee or Royal Commission of Inquiry, there will be fraud, deception and cheating,” Mat Zain said.

Robert Phang lodges report over book on Gani

Former Malaysian Anti-Corruption Commission (MACC) advisory panel member Robert Phang has urged the authorities to probe attorney-general Abdul Gani Patail’s alleged abuses of power as described in a new book entitled ‘Tan Sri Abdul Gani Patail: Pemalsu, Penipu, Penjenayah?’

Phang (left) said that he wants the police and MACC to investigate the allegations against Abdul Gani in the 123-page book, written by lawyer Zainal Abidin Ahmad.

He has also asked the AG to investigate the accusations made in the book and sue the author for defamation if the allegations are wrong.

“The AG must seriously address the issue made in the public domain and should not be a liability to the government,” he told Malaysiakini today after lodging a police report this morning.

He made the report at around 11am at the Jalan Tun Razak police station in Kuala Lumpur.

The 14-chapter book was self-published by Zainal recently.

Due to the allegations made in this book, Phang had last week challenged Abdul Gani to come forward and clear his name.

During a press conference last week, he had urged the attorney-general to take responsibility and not to be a stumbling block to the BN.

1. The recent decisions and happenings in the Courts have shown how badly the AG’s Chamber is handling cases and matters of public importance. It is a reflection that the chief legal adviser of the government namely the Attorney-General Abdul Gani Patail has again failed the government. It shows that AG Gani Patail has failed to properly advise the government and its ministries on the proper interpretation and implementation of the law. His bad advices to the government have resulted in the government being scorned and YAB PM Najib is made to look very bad in the eyes Malaysians and the world at large, especially in the recent book ban case and the prosecution of an ordinary Malay girl, Nik Raina Bte Nik Abdul Aziz, of Borders Bookstore.

2. That is the public perception when they see so many clear cases of abuses and selective prosecution by AG Gani Patail. That is the public perception when former Solicitor-General II Datuk Yusof Zainal Abiden chose to defend Anwar Ibrahim who is facing charges of taking part in the Bersih Rally on 28th April 2012, and yet Bersih is now declared not illegal by the High Court. That is the public perception when more and more ex- ministers and ex-senior civil servants declare support for the opposition.

3. In 2011, I raised the issue of AG Gani Patail questionable conduct which was the subject of the discussion in public domain forums, especially of his Haj Trip with one shady character, Shahidan Shafie, a proxy of MAS former Chairman, Tajudin Ramli. There were photographs and documents. I had also questioned AG Gani Patail’ s conduct of consorting with Datuk Vincent Lye in taking sides in the boardroom tussle of Ho Hup Bhd by prosecuting Vincent’s adversary, Dato TC Low. Again, there were pictures of AG Gani Patail with Vincent Lye at Ho Hup’s office.
