Why were previous video recordings of the Teoh Beng Hock inquest uploaded on the website of the Attorney-General's Chambers, but not of the last session?Does this have anything to do with the less-than sterling performance of the Malaysian Anti-Corruption Commission's (MACC) head of prosecution Abdul Razak Musa at the last hearing?Raising these questions today, DAP lawmaker Lim Lip Eng said the prosecution's failure to put up the video of the inquest proceedings of Aug 18 is an indication of its lack of neutrality.
“The AG's Chambers have put up videos of the proceedings on their website since Day 1 of the inquest. So why blank out the latest one?” the Segambut parliamentarian said at a press conference today.“This just shows that they are biased, although the they are supposed to be a neutral party in this case."He revealed that he had been in touch with the AG's Chambers over the matter, but with laughable results.
“I called them yesterday to ask why they have not put up the video. At first they told me that there were some 'technical issues'. But after I asked them again and again, they said they couldn't find the video,” he said.“The proceedings on Aug 18 were ... the funniest and the one with the most suspense. Are they purposely trying to hide it?”Lim also issued an ultimatum to the AG's Chambers to put up the video within 24 hours."If not, then they will have to take down all their videos. Being selective in posting the videos defeats their purpose of being open and transparent," he said.He will also ask lawyers Malik Imtiaz Sarwar, who acts for the Selangor government and Gobind Singh Deo, who represents Teoh's family, to file a formal complaint with the coroner's court.
'Not subjudice'
Lim, who is a lawyer, pointed out that an inquest is not a full-fledged legal proceeding.“That is why the AG's Chambers can put up the video on their website. And that is why I can talk about this. Subjudice does not apply in this case,” he said. While coroner Azmil Muntapha Abas has the authority to tell the AG's Chambers not to record the proceedings, the latter has the power to ignore this, he said.“Outside the court, (the coroner) has no power. But inside the court, he may ask for the video recorder to be turned off,” said Lim.
On Day 43 of the hearing, Abdul Razak had crossed swords with Thai pathologist Dr Pornthip Rojanasunand, who was engaged by the Selangor government. He first attacked her credentials and then left the court in stitches when he suggested that Teoh had strangled himself - and demonstrated this for packed court room. The inquest is scehduled to continue on Sept 1.
