1. The recent decisions and happenings in the Courts have shown how badly the AG’s Chamber is handling cases and matters of public importance. It is a reflection that the chief legal adviser of the government namely the Attorney-General Abdul Gani Patail has again failed the government. It shows that AG Gani Patail has failed to properly advise the government and its ministries on the proper interpretation and implementation of the law. His bad advices to the government have resulted in the government being scorned and YAB PM Najib is made to look very bad in the eyes Malaysians and the world at large, especially in the recent book ban case and the prosecution of an ordinary Malay girl, Nik Raina Bte Nik Abdul Aziz, of Borders Bookstore.
2. That is the public perception when they see so many clear cases of abuses and selective prosecution by AG Gani Patail. That is the public perception when former Solicitor-General II Datuk Yusof Zainal Abiden chose to defend Anwar Ibrahim who is facing charges of taking part in the Bersih Rally on 28th April 2012, and yet Bersih is now declared not illegal by the High Court. That is the public perception when more and more ex- ministers and ex-senior civil servants declare support for the opposition.
3. In 2011, I raised the issue of AG Gani Patail questionable conduct which was the subject of the discussion in public domain forums, especially of his Haj Trip with one shady character, Shahidan Shafie, a proxy of MAS former Chairman, Tajudin Ramli. There were photographs and documents. I had also questioned AG Gani Patail’ s conduct of consorting with Datuk Vincent Lye in taking sides in the boardroom tussle of Ho Hup Bhd by prosecuting Vincent’s adversary, Dato TC Low. Again, there were pictures of AG Gani Patail with Vincent Lye at Ho Hup’s office.
4. Because of that, I became the subject malicious attacks by anonymous mercenary bloggers obviously hired to defend the AG’s conduct. To protect the MACC’s integrity, I voluntarily resigned from the MACC’s Advisory Panel in order to facilitate the hasty investigation against me. On 31 May 2011, Tan Sri Datuk Dr. Hadenan, who chairs the MACC Operations Review Panel announced that I have been cleared of those allegations. But, it was apparent that he was more interested to clear AG Gani Patail when his Press Statement stated that:
Kes siasatan terhadap Tan Sri Abdul Ghani Ptail, Peguam Negara yang ditohmah mendapat pembiayaan bagi menunaikan ibadah haji dan berpuas hati bahawa siasatn juga tidak menunjukkan keterangan bagi sebarang kesalahan jenayah.”
5. Since that announcement, I have been the subject of ridicule and scorn. Even the blog, Malaysia Today made reference to this on Sunday 12th June 2011, by saying that I have only been given a “conditional clearance” so that I can be curbed and muzzled. The choice of words of Tan Sri Hadenan’s press statement was very mischievous calculated to leave a cloud hanging over my head. It is of paramount importance for me to make very clear, that I will not have my integrity being questioned or aspersions being cast against me in that way. I would not be muzzled by attempts to clear me in such a conditional manner. I now show to you the MACC letter 28th October 2011 that cleared me unconditionally.
6. On the other hand, I now show you a signed copy of a book which was sent to me recently. The title is “Tan Sri Abdul Gani Patail Pemalsu, Penipu, Penjenayah?” authored by Zainal Abidin Ahmad. The book detailed out all the abuses, corruption, and criminal acts of AG Gani Patail. I challenge AG Gani Patail to investigate, arrest and charge the author if the contents are untrue and also sue him for defamation. Otherwise, I challenge the MACC and the Police to investigate these allegations against AG Gani Patail. Pending the investigations, I challenge AG Gani Patail to step down and go on leave to show that the investigations are not tainted. I will lodge a police report and surrender the above said book to PDRM for their necessary action.
7. Today, I was in court to observe the KLHC Criminal Appeal No. 42-188-10 in PP v Rosli Dahlan, before Judge Dato Azman Hussain. The MACC has finally withdrawn their appeal against Rosli. But why wait until the last minute? Why do it during Ramadan? What I saw was that the MACC and AG Gani Patail only withdrew at the last minute because they were afraid they would lose this appeal. That is why they waited until the last minute which show how vindictive the AG is against Rosli because he refused to settle his civil suits against the government officers who abused him. The AG wanted to make Rosli a scapegoat and to teach him a lesson. The AG wanted to bankrupt Rosli with all the hefty legal cost that he has to incur to defend his innocence.
8. AG Gani Patail is now the biggest liability to the BN goal and the government under PM Najib’s leadership. “CHANGE or be CHANGED is still very fresh in rakyat’s mind. My advice to AG Gani is that he should not show disrespect to the PDRM and MACC. I have seen him belittling the Police and MACC top leadership in the presence of others by blaming them for the acquittals from the courts. That responsibility lies with the AG Chambers because AG has always professed minimum 90% of evidence before cases go to courts. Yet, AG’s chambers lose their cases. The AG must take the blame and not shift it to someone else.
9. That is how shameless and perverse AG Gani Patail is. That is how he waste public funds on pursuing useless cases and yet closing an eye on cases that are really of public importance. I say to YAB PM Najib Razak, remove AG Gani Patail! Remove him, otherwise the government will continue to be ridiculed, derided and scorned.
