Silence 'not an option', ex-AG Abu Talib tells Gani

Esscom told to buck up

PETALING JAYA: Social Care Foundation chairman Robert Phang criticized the newly established Eastern Sabah Security Commission (Esscom) following the recent attack on the Taiwanese tourist in Sabah; while issuing a strong advice to the body by urging them to fix the loopholes.

The social activist said the incident has clearly indicate that the security system imposed by the body is not attack proof.

“I know that they are doing their best, however this incident shows that the system is not good enough to prevent such a tragic incident and it has happened again in Sabah.

“Somehow, somewhere is wrong and Esscom must seriously look at the loopholes. Undoubtedly Esscom have weaknesses that needs to be ratified ,” the 75 year-old said.

During the wee hours of Friday morning a group of terrorists believed to be Abu Sayyaf had killed a 57 year old Taiwanese identified as Lim Min Hsu and kidnapped his 58 year old wife An Wei Chang .

After five days of search, the authorities have yet to identify the exact location of the victim and receive any updates from the abductors.

Phang then agreed with a statement made by the Inspector General of Police Khalid Abu Bakar yesterday adding that police should not reveal any plans and progress about the case publicly.

Dr Ling’s acquittal shows Putrajaya’s graft war farcical, say critics

Putrajaya's war against crime in high places appears to be a farce, judging from the way former cabinet minister Tun Dr Ling Liong Sik (pic) was charged, and later acquitted, say a former attorney general and a veteran lawyer.

Both Tan Sri Abu Talib Othman and Karpal Singh felt that Dr Ling should not have been charged in the first place and that the four-year court battle which followed was simply a charade by Putrajaya to portray it was serious in getting a "big fish".

They questioned why ex-prime minister Tun Dr Mahathir Mohamad's statement was not recorded before Dr Ling was charged with allegedly cheating the Cabinet over the Port Klang Free Zone (PKFZ) land project in 2010.

"If Dr Mahathir's statement was recorded earlier, then the Attorney General would have had to think twice whether to frame charges against Dr Ling," Abu Talib told The Malaysian Insider.

Police only recorded two statements from Dr Ling's former boss in 2011 and early last year as the trial was progressing.

Cries of police officers baffling activists

PETALING JAYA: The vice chairman and the executive council member of the Malaysian Crime Prevention Foundation have expressed disbelief towards the plight of police officers in the country.

The issue was highlighted in a story FMT carried yesterday upon interviewing some personnel from the force.

When called for comments, Lee Lam Thye and Robert Phang were stunned to be made aware that police personnel are facing shortage of funds in their respective departments.

Earlier, in a phone conversation, Lee requested FMT to send an email with regards to the issue as he has yet to be briefed about the matter.

However, later in a short sms exchange, Lee notified FMT that he wished to personally check and confirm the issues before making any comments.

“I am sorry, no comment at the moment, I wish to check and confirm the matter first,” said Lee who is also a social activist.

On the other hand, Phang when contacted repeatedly asked whether the allegations by police officers came from solid data.

“Are you sure this is happening,” he asked.

Upon being given more details, Phang immediately told FMT that the occurring problems have to be addressed as soon as possible; and further stressed that it must be stopped immediately.

PREVENTION OF CRIME ACT: Select outspoken panellists

THE government should refrain from appointing "shoeshine guys" to sit on the Prevention of Crime Board under the newly passed Prevention of Crime (Amendment and Extension) Act (PCA) 2013.

They should opt for outspoken individuals, besides those from the judiciary, among academicians and non-governmental organisations (NGOs). The panel members should also be increased to five from three.

A panellist with legal knowledge would be able to upkeep justice, while an academician could provide a philosophical aspect to the law. NGO members will provide check and balance.

They are the ones who go to the ground to get feedback and know the sentiments on the ground.

The NGO members must have the guts to speak without fear or favour. They must be apolitical.
I would like to offer myself for the post because I can speak my mind.

The board has an important role in the PCA as its members have the power to send a criminal on a two-year detention without trial and can further extend the detention period by another two years.

The government should consider including a provision in the act to allow detainees to periodically seek judicial review on a detention order.

We should allow criminals to challenge the decision. Otherwise, it is going to be hard for the people to accept the act, as it can be considered a human rights violation.

PCA Panelist or Members Must Have Guts :- Speak and Act Without Fear and Favour

Former MACC advisory panel member also urges government to make amendments to the PCA so that a detention order can be challenged in court.

KUALA LUMPUR: The government should refrain from appointing “shoeshine guys” to the proposed three-member Prevention of Crime Board under the newly passed Prevention of Crime (Amendment and Extension) 2013 Act.

“They should opt for outspoken individuals like me,” said Social Care Foundation chairman Robert Phang.

The Prevention of Crime Board is set to play an important role in the PCA as its members have the power to send a person for a two-year detention without trial.

The board can then further increase the detention period by another two years. PCA prohibits judicial reviews on the board’s decisions except on procedural requirements.

The Prevention of Crime Board is to consist of a former judge of the Federal, Appeals, or High Court, and two other people whose qualifications are not specified.

The government has not mentioned any names to be part of the board.

Umno's blunder over Chin Peng's place in history

Koon Yew Yin

Almost two years after my meeting with Chin Peng in Bangkok on Oct 2, 2011, I learnt - as did other Malaysians - of his death on Sept 16, 2013.

His passing on is not unexpected as he had been ill for some years.

What is unexpected is the government’s refusal to allow his ashes to be returned to Malaysia, his home country for which he fought for liberty and freedom, initially against the Japanese and then against the British.

Chin Peng was a freedom fighter in every sense of the word. His record of defiance and opposition to Japanese and British colonial rule in Malaya is unprecedented.

It is comparable or even exceeds that of anti-colonial leaders such as Ho Chi Minh, Mohammad Hatta, and Jawaharwal Nehru who were his contemporaries in Asia’s struggle to free itself from the yoke of western powers and Japan in the mid twentieth century.

Other leaders that come to mind during that crucial period of nationalist ferment after the Second World War are Kwame Nkrumah, Gamal Abdel Nasser and Patrice Lumumba.

In all those countries whether in Asia, Africa or Latin America where the anti-colonial and nationalist freedom fighters fought, they have been accorded due recognition and honour.

But not in Malaysia where Umnoputraism has sought to stamp its racial and religious politics on every aspect of life in the country - dead and living; past, present and the future.

Why Chin Peng’s ashes are not allowed back

It is sickening to read the lame excuses that Umno leaders, in particular Home Affairs Minister Ahmad Zahid Hamidi, have given to prevent the homecoming of Chin Peng’s ashes.

These excuses range from the allegation that Chin Peng never applied for citizenship to concern that a memorial may be erected for him and fear that he would be treated as a “hero”.

Well, I have news for Umno. Chin Peng is a patriot and hero in the eyes of many who are knowledgeable of that historical past of Japanese and British colonial rule in Malaya and the contributions of the Communist Party of Malaya (CPM) in fighting to free our country.

Chin Peng had three failings. One is that he and the CPM though engaged in an armed struggle against the British should have ceased it as soon as the country gained its independence.

This fact of CPM responsibility for killings and bloodshed, including of innocent civilians, is undeniable and needs to be fully recorded.

He had two other failings - if we can call it that - which have prevented him from getting due recognition in his homeland.

The first is that he fought for the wrong ideology. Now if he had collaborated with the Japanese and negotiated peacefully with the British and sucked up to them the way many other leaders did, perhaps he may not have been so vilified.

Our history books on the Japanese occupation of Malaya need to record the names of Umno and other leaders who actively supported and collaborated with the Japanese in their murderous and bloodstained rule.

Let Malaysians then draw their own conclusions as to who are the true nationalists and patriots; who are the opportunists and collaborators; and which were the families and loved ones that died during Japanese and British colonial rule and who do not want the return of Chin Peng’s ashes.

His other failing appears to be that he is a Chinese. Others have pointed out that if Chin Peng was a Malay, his place in Malaysian history and his ashes would be treated differently.

I am sure there is more than a grain of truth in this.

Chin Peng’s wish for Malaysia

My reason in writing this is not simply to remind of some uncomfortable truths and facts of our history but to point the government towards a correct and fair closure of this particular episode of our history.

During my meeting with Chin Peng, I asked if he was keen to return to Malaysia and what is his advice for the Malaysian Chinese.

His immediate reply was that he yearned to return to his homeland and to die in his birthplace.

He also emphasised that Malaysia is a rich country and that the Chinese must work together and cooperate with the Malays to make Malaysia a better country.

He had hoped that under the 1Malaysia policy the government would allow him to return to the country to show that there is no bitterness towards the Communist Party of Malaya since both sides were fighting against a common colonial power enemy.

It would also show that the government is serious about the truthful portrayal of the history of Malaya which is one in which all races have contributed.

This would also help in getting rid of the misunderstandings and distortions that have plagued our views of the past and lay the groundwork for racial unity and solidarity.

Treating the case of Chin Peng with compassion and statesmanship, and permitting him to return to Malaysia - his home country - besides putting the historical record straight, would have been an important building block for our race relations.

The way Umno is going about it is totally wrong.

Governing the country is like managing a very large business corporation. The definition of good management is to get all your stakeholders - this includes staff - to do their share of work.

Staff can only do it if they are motivated. The government should have taken advantage of this situation to win the Chinese over to work harder for the country.

Sadly, this has now become more difficult to achieve because of Umno’s blinkered and narrow-minded ideology.

MCA: Muslim terrorists buried here, why not Chin Peng?

Turning up the heat ahead of Chin Peng's cremation, MCA questions the government’s double standard in reference to  the burial of two Muslim terrorists in the country.

The party's publicity chief Heng Sia Kee said the government should not appear as being racist and allow the former communist leader’s ashes to be brought back.

NONEHeng was referring to the late Azahari Husin and Nordin Mohamad Top, both of whom were wanted by the Indonesian government for the 2002 and 2005 Bali bombings, attack on Jakarta's JW Marriott hotel in 2003, and on the Australian embassy in 2004.

They, too, were far from being Malaysian heroes, noted Heng.

"Whether Chin Peng is a hero or not is not an issue here. The government does not need any more bad publicity to be seen as making decisions based on racial lines," she added.

Furthermore, Heng said, both Azahari and Nordin could be considered the worst villains as they sought out innocent lives for destruction.

Azahari and Nordin were both colleagues in Universiti Teknologi Malaysia (UTM) in Johor before allegedly climbing the ranks of Jemaah Islamiah (JI), a terrorist network linked to Al-Qaeda.

'Stand by your promises on Chin Peng'

Honour your promises and don't try to milk the death of communist party leader Chin Peng for political mileage, a constitutional expert today told the Umno-BN government.

Abdul Aziz Bari said the government would lose its authority if Home Minister Ahmad Zahid Hamidi and Inspector-general of Police (IGP) Khalid Abu Bakar continued to vehemently oppose Chin Peng's final wishes for his ashes to be interned in Malaysia.

He reminded them that the 1989 ceasefire agreement between the government and the Communist Party of Malaysia (CPM) was signed by former premier Dr Mahathir Mohamad, with their respective predecessors in tow.

NONE"Stop manipulating the emotions of the army and police veterans. Just put up or shut up!" Abdul Aziz (right), a former professor at the International Islamic University of Malaysia said in a press statement.

Khalid had said all checkpoints are being watched to ensure that Chin Peng's body was not smuggled in as Chin Peng was responsible for the death of many police and army personnel during the Emergency.

"Khalid should just shut up or ask his own predecessor as to why the police agreed to sign the truce with the communists," Abdul Aziz retorted.
'Wrong to reject application'
Abdul Aziz said that with the signing of the 1989 document, Malaysia had tacitly recognised the communists.

"The court was wrong to reject Chin Peng's application to come back. The judges asked for documents to prove his citizenship, like a birth certificate. But they knew that it was during the height of emergency and Chin Peng - rightly or wrongly - was a fugitive," Abdul Aziz said.

He added that the court had asked the impossible from Chin Peng, who had fought British rule.

Noting that even some ex-Umno and BN leaders were also detained in the past for communist activities, Abdul Aziz said that the party should stop "demonising" communists and communism.

No way Chin Peng’s remains can return to Malaysia, says former police chief Hanif

"We don't owe Chin Peng anything. He caused Malaysia and its people a lot of harm which resulted in more than 10,000 deaths and untold misery for the families of those who died," said former Inspector-General of Police Tun Hanif Omar (pic) in dismissing calls for the remains of the former Communist Party of Malaya leader to be brought back to Malaysia.

According to Hanif, Chin Peng and his followers had refused an offer to return to the country within a year of signing the peace accord in 1989.

"When Chin Peng finally applied in 2005 to return to Malaysia, the boat had sailed and there was absolutely no reason to admit him back into the country unless he could prove that he had applied to return within that one-year window, which he couldn't," Hanif told The Malaysian Insider in a text message yesterday.

The former IGP who served from 1974 to 1994 instead called for more focus on those who had fought and defeated Chin Peng and his party, insisting that the families of security personnel who fought the communists should be looked after.

"Chin Peng and his followers refused the chance we gave them to return to Malaysia in 1989 and 1990, so they should be left outside our country.

WAR ON CRIME: We can pray for peace and wellbeing of our country

MALAYSIANS should welcome the decision by Prime Minister Datuk Seri Najib Razak to start an all-out war against crime.

The police and other authorities and non-governmental organisations will be tasked to prevent crime and to step up efforts to stop serious crime.

This situation is serious, and I hope all Malaysians understand how serious it is.Thus, I appeal to all Malaysians to participate and support the authorities in their goals.

On humanitarian grounds, I wish to emphasise that life is precious. Taking another person's life is an unforgivable act.

Taking a person's life not only affects the victim, but it also affects his family, who will experience pain and trauma.

Therefore, all must remember that we should and must not be allowed to kill a human being.

At the same time, when we have a quiet moment, let us pray for peace and the wellbeing of our nation.

Malaysia is a beautiful country. We need to restore the good relationship among her people, that we once possessed.

We need to live peacefully and harmoniously, for the good of the nation.

Tan Sri Robert Phang, Justice of Peace and Social Care Foundation chairman

AN ALL OUT WAR ON CRIME PLEASE STOP KILLING – TREASURE LIFE!!!

The Malaysians should welcome the decision by YAB PM Dato’ Seri Najib Tun Razak to start an all out war against crime immediately.

It is noted that PDRM together with YB Dato’ Seri Dr. Ahmad Zahid, Minister of Home Affairs plus other related authorities and NGOs will be tasked to prevent crime and step up all efforts to stop crime from further deteriorating in Malaysia. This has resulted in a situation when all of us need to be pragmatic and realize that the current situation is serious.I appeal to all the fellow Rakyat to come forward to participate and support the authorities in this direction.

On humanitarian grounds, I wish to emphasize that life is very precious. We only live once, we must surely treasure our lives as well of our love ones.Taking another person’s live by killing is very unforgivable. The suffering and trauma of the relatives of the victim, will be very tough and miserable. Therefore, all of us must remember, we should and must NOT be allowed to kill and take the life of another human being. Surely and truly, this is ONLY possible in the hands of God. At the same time, when we have a quiet moment, let us pray for peace and well-being for our nation.

Malaysia is still a beautiful country. We need to restore back good relationship among all the various races and religions. We need to live peacefully and harmoniously, let us turn to God to protect and bless all of us at all circumstances. We must avoid and ditch the “TIDAK APA’ attitude.

Lastly, we must treasure life!

MCA’s future - Lim Mun Fah

After experiencing a great defeat, the call for MCA president Datuk Seri Dr Chua Soi Lek's resignation has grown stronger. The infighting has surfaced and the party election scheduled at the end of this year is expected to be an arena fighting for the party's top posts.

Deputy president Datuk Seri Liow Tiong Lai has been the first to announce his wish to contest for the presidency, lifting the curtain on the fight.

Who else would be contesting? Would former president Datuk Seri Ong Tee Keat make a comeback?

Would the incumbent president handpick his successor? How about followers of another former president Tan Sri Ong Ka Ting? What would MCA Youth Chief Datuk Dr Wee Ka Siong do?

These questions will certainly be the focus of the media, as well as those who are interested in politics.

The MCA party election is scheduled in December this year and any unexpected changes could take place within the following five months. Therefore, it is still too early to say who has the highest winning odds.

For party outsiders, the focus is actually not on who is going to lead the MCA in the future, but what kind of party would the MCA be after changing its leadership.

The challenge before them is, under the new situation after the general election, how should the MCA adjust its position?

Phang calls for post-mortem into GE13 setback

A leading Malaysian social commentator has urged Prime Minister Datuk Seri Najib Razak to conduct a “genuine post-mortem” into why  voters had drifted away from  the  Barisan National party at GE13.

Tan Sri Datuk Robert Phang, the founder and chairman of Social Care Foundation, said Najib is  the best person to get to  the root cause of the political  malaise, especially among the Chinese.

Phang said the Malaysian Chinese Association had become dysfunctional and was completely  rejected by its  own community. They have failed to connect with their constituents and this is a disaster.

“The MCA brand had been tarnished and cannot be redeemed. There is no Chinese representation in Cabinet. This is very disappointing. So something has to be done,” he says.

“Only Najib has the stature and authority to bring all communities together. He is very sincere when he says ‘I want to rule for all Malaysians.’ This is very encouraging.”

Phang was in Melbourne  to address the powerful Victorian Chinese Chamber of Commerce at the weekend.

Chamber secretary Chuen Lim, a lawyer, formerly of Teluk Intan, who organised Phang’s visit, said only 150 people could be accommodated at Seasons, the Malaysian-owned hotel and there were many more who wanted to attend.

Phang said Najib is a great leader and no one in BN or UMNO can come anywhere near the prime minister  or surpass him  in understanding the needs and aspirations of Malaysians.

“Najib has demonstrated very convincingly that he would like to continue working on plans and programmes for the betterment of Malaysians.”

“But he  needs to  win the support and confidence of the Chinese and Indians. This I am sure he will achieve.”

Phang  said “the arrogant MCA” had left a vacuum after its shocking  election performance. “But there are many apolitical Chinese leaders of high repute and calibre  in Malaysia  who can be persuaded to fill the breach and give the Chinese a strong voice in the country.”

Phang also took a swipe at the MCA over the “Dong-zhong” – united education certificate –debacle . “MCA mismanaged and manipulated the whole issue,” he says.

Phang said Najib has to  ”work hard …  and work smart” to tackle the warring political factions, disgruntled politicians and extremists.

“Because of his family heritage, British training, open-mind and being very receptive to suggestions I feel confident Najib is the man of our times who can unite the nation.”

“Najib has  many times said  ’change, or be changed’. He understands the seriousness of the situation and we can expect reforms within Umno and BN.”

“Despite his detractors, the prime minister  was given a resounding mandate at the election and he can move forward  with confidence and with authority.”

“It is significant that former Prime Minister Tun Dr  Mahathir Mohamad has endorsed Najib’s leadership.”

Phang said it is vital to have a strong opposition to provide checks and balances. “But they must be constructive and effective, not just shouting slogans and marching down the streets.”

He said rallies mooted by Datuk Anwar Ibrahim are unproductive, destructive and deceptive and would drive foreign investment away.

“Malaysia is a beautiful country. I want to see it grow and prosper.”

Are you a “SHOE SHINE BOY” ?

Haw Chin Teck - Johor MCA Youth Chairman

I am a senior citizen and have seen many politicians come & go. Some were really devoted & productive – but there were also opportunists, hoping to become politician, MP’s /Aduns with their personal agenda. Even now there are still many plentiful within MCA.

What is important one needs to be far sighted, up right without personal agenda and prepare to speak an uphold justice without fear and favor.

In politics, unfortunately you are bound to have many.“Shoe Shine Boys”. Some speak because of given instructions by their bosses (Hopeless Type) – I do not know where do you belong?

Only for the sake of speaking then you are totally a useless chap. My advice to all young people, speaks only on need to. Otherwise keep your mouth “SHUT”. For sure nobody will say you are a DUMB & useless chap.

The MCA political landscape has changed. Chinese communities are no longer fools. We now OPEN our ears & eyes. What has been said by me recently is just a simple TEST but all of you are already RESTLESS.

How to win the Chinese back to support MCA. ???

You need to get your facts right before you write any article, otherwise you will appear like a fool or perceived by others as a typical " SHOE SHINE BOY"

God Bless You.

Get your claws off Ka Siong - MCA tells 'busybody' Robert Phang

Social Care Foundation chairman Tan Sri Robert Phang is a seasoned veteran who always pokes his head into MCA’s affairs and insults our leaders. We deeply question whether he has any ulterior motives in doing so, and we strongly urge him to stop trying to disrupt MCA’s party elections as his behavior has disgusted us.

Without any prior provocation, Robert had suddenly decided to criticize our national Youth chairman, Datuk Dr Ir Wee Ka Siong. This is puzzling and as such, we request that Robert explain to the public whether or not he is pursuing his own political agenda behind the scenes.

On 21 June 2013, the Sultan of Johor himself had declared that he wanted the Chinese community to be represented in the state executive council, and this was done to reflect His Royal Highness’ wishes.

However, Robert had acted on rumours by accusing Ka Siong of disrespecting the Sultan. There is a strong political motive behind this move, and Robert’s attempt to disassociate himself from this issue proves that he is trying to hide something.

MCA’s election is done according to the process of democracy, especially since our terrible loss at the 13th General Elections Nevertheless, this does not mean that MCA has given up. Our coming elections will provide us with an objective to attain.

Despite our setbacks, MCA still holds on to its dignity and all its members will work towards protecting this.

Haw Chin Teck
Johor MCA Youth Chairman

Phang Wants Wee To Apologise To Sultan

KUALA LUMPUR: Social Care Foundation chairman Tan Sri Robert Phang today slammed MCA Youth chief Datuk Dr Wee Ka Siong over his disrespectful remarks against Sultan of Johor, Sultan Ibrahim Sultan Iskandar.

Speaking to the media in Ampang, Phang said that Wee in an interview with China Press yesterday had repeatedly reiterated what he had said before on the appointment of MCA’s Tee Siew Kiong as a member of the Johor state executive council.

On May 21, Wee had said that MCA members who were clinging on or want to take any government posts should be sacked, including Tee who was appointment as Johor exco member based on a request made by the Johor ruler.

MCA had previously agreed to sit out of all government posts in the event it did miserably in the 13th general election. Following its dismal performance, the party stood by its decision but Tee agreed to become a state exco meber following the request of the sultan.

Tee has been suspended from the party for taking the state position, while Wee had said that he was informed that the sultan had only wanted a Chinese representative in the state exco, and not necessarily Tee.

However, on July 1, the sultan, through his private secretary, urged all quarters, including MCA, to respect the decision made on Tee’s appointment. Sultan Ibrahim added that it was inappropriate to continue to question the power of the sultan as the state ruler.

“The sultan has came out with a statement. Why Wee is still talking about this matter? I view this as a clear and serious act of disrespect and it appears that he has misled the public. His actions is outrageous and deceptive,” said Phang today.

Phang then urged Wee to apologise publicly to the sultan over his action and advised Wee not to drag the royal institution over this issue again.

“I want him to apologise. That’s all. He has committed a criminal offence of sedition under the Sedition Act and criminal defamation under Section 500 of the Penal Code. As a Malaysian, he should apologise to the sultan,” Phang said.

Phang also requested for the Attorney General and the police to investigate Wee urgently on his disrespectful conduct against Sultan of Johor.

“Swift action is imperative so as to prevent such unacceptable behaviour and to stop others from challenging the privileges and rights of the Raja Raja Melayu,” Phang concurred.
